By engaging with Samani ECC, whether through our website, physical showroom, sales representatives, or installation services, you agree to be bound by these Terms.
If you do not agree with these Terms, please do not use our services or place an order.
Services Provided
Samani ECC specializes in the manufacturing, supply, and installation of:
- Sliding Windows
- Sliding Doors
- Aluminium Fabrication
- Glass Partition Solutions
- Customized Architectural Products
Eligibility
By engaging with Samani ECC, you confirm that:
- You are at least 18 years old,
- You have the legal authority to enter into binding contracts,
- If ordering on behalf of a business or organization, you have the proper authorization.
Product Orders and Customization
- Orders may be based on standard catalog models or fully customized designs.
- Once a design, material specification, and quotation are approved by the customer, the order is considered final.
- Any post-approval changes may incur additional charges or extended delivery timelines.
- Customers are responsible for verifying all dimensions, designs, and finishes before approving an order.
Site Readiness and Customer Responsibilities
- Customers must ensure that installation sites are ready, clean, and structurally suitable before installation.
- Necessary approvals from building management or society must be obtained by the customer.
- Electrical, masonry, or civil work unrelated to installation is the customer’s responsibility.
Payment Terms
Advance payment is mandatory before manufacturing begins. Typical payment structure:
- 50% Advance upon order confirmation,
- 40% upon product dispatch or site delivery,
- 10% upon installation completion.
All payments must be made through accepted channels (bank transfer, cheque, UPI, etc.).
Delayed payments may attract interest charges of 2% per month on the outstanding amount.
Delivery Timelines
- Delivery and installation timelines are indicative and depend on material availability, production load, and external factors.
- We are not liable for delays caused by force majeure events such as strikes, natural disasters, supplier issues, or transportation restrictions.
Warranty
- Samani ECC offers a limited warranty of 1 year on fabrication quality.
- Warranty covers manufacturing defects only and excludes:
- Damages due to mishandling, accidents, misuse,
- Environmental wear and tear (corrosion, rust in coastal areas, etc.),
- Unauthorized repairs or modifications.
- Glass breakage, hardware wear, and sealant failures are not covered unless specified in writing.
Cancellations, Returns, and Refunds
- Custom orders are non-cancellable and non-refundable once production begins.
- In case of cancellation before manufacturing, a cancellation charge of up to 25% may apply.
- Standard (non-customized) products may be returned within 7 days if unused and undamaged, subject to inspection and restocking fees.
Intellectual Property
- All designs, images, logos, product names, and catalog content are the intellectual property of Samani ECC.
- You may not reproduce, copy, or exploit any part of our intellectual property without express written consent.
Limitation of Liability
- Samani ECC is not liable for any indirect, incidental, special, or consequential damages arising from the use, inability to use, or performance of our products or services.
- Our maximum liability for any claim relating to the products shall not exceed the price paid by the customer for the specific product or service.
Force Majeure
We are not responsible for delays, damages, or non-performance due to causes beyond our control, including but not limited to:
- Acts of God
- Government actions
- Supply chain disruptions
- Transportation delays
- Labor shortages
Changes to the Terms
We reserve the right to modify these Terms at any time. Updates will be posted on our website or communicated directly. Continued use of our services after changes constitutes acceptance of the revised Terms.
Governing Law
These Terms shall be governed and construed in accordance with the laws of the Republic of India, without regard to conflict of law principles.
Dispute Resolution
- Any disputes or claims arising out of or relating to these Terms shall first be attempted to be resolved amicably through mutual discussions.
- If unresolved, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996.
- Venue for arbitration shall be Mumbai, India.
- Language of arbitration: English.
